Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Site Detection website and website-monitoring services (the "Service"), operated by Site Detection ("we", "us", or "our"). By accessing the Service, creating an account, starting a trial, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Site Detection monitors the websites and endpoints you configure and notifies you about their availability and response times. The Service is a monitoring and reporting tool only. We do not host, repair, or manage your websites, and we are not responsible for your sites' availability or performance.
2. Accounts & Eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. You may only monitor websites and endpoints that you own or are authorized to monitor.
3. Free Trial
We may offer a free trial. At the end of the trial, continued use of paid features requires an active subscription. We may change or discontinue trials at any time.
4. Subscriptions, Billing & Auto-Renewal
Paid plans are sold as recurring subscriptions billed monthly or annually through our third-party payment processor. By subscribing, you authorize us and our processor to charge your payment method the then-current fee, plus applicable taxes, on a recurring basis until you cancel. Subscriptions automatically renew at the end of each billing period at the then-current price. We may change prices or plan features on prospective notice; continued use after a change takes effect constitutes acceptance.
5. Cancellations & Refunds
You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period. Fees already paid are non-refundable and partial periods are not prorated, except where required by law.
6. Your Responsibilities
You are responsible for configuring your monitors and alert settings correctly and for keeping your contact details current. Alerts and reports depend on factors outside our control, including your network, your email and SMS providers, and third-party services.
7. Acceptable Use
You agree not to use the Service to monitor systems you are not authorized to monitor, to place an unreasonable load on any target, to probe or attack third-party systems, to interfere with the Service's operation or security, or to violate any law or third-party right.
8. No Guarantee
While we strive for accurate, timely monitoring, we do not guarantee that every outage or issue will be detected or reported, that alerts will always be delivered, or that the Service will be uninterrupted or error-free. The Service is not a substitute for your own operational safeguards.
9. Intellectual Property
The Service, including its design, text, and software, is owned by us or our licensors and is protected by law. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.
10. Third-Party Services
We rely on third parties, including payment processors (such as Stripe) and email and SMS providers, and the Service may integrate with or link to third-party services. Your use of those services is governed by their terms, and we are not responsible for their content or practices.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, INCLUDING ANY LOSSES ARISING FROM UNDETECTED OR UNREPORTED DOWNTIME. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Site Detection and its owners, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms or any law or third-party right.
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
15. Changes & Termination
We may modify these Terms or the Service at any time. Material changes will be posted here with an updated date, and continued use constitutes acceptance. We may suspend or terminate the Service or your access at any time, with or without cause.
